KidShowcase – Terms of Service

Welcome to KidShowcase! Please read these Terms of Service (“Terms”, “Agreement”) carefully before using the KidShowcase platform, website, and services operated by KidShowcase LLC (“KidShowcase”, “we”, “us”, or “our”).

Important Notice Regarding Fees, Payouts, and Financial Responsibilities

By registering, creating an event, running a fundraiser, or using our payment features, you explicitly agree to KidShowcase’s platform fee structure (5% on organization fundraisers, 15% on event registrations) and acknowledge that all payment payouts, chargebacks, dispute recoveries, and financial verifications are governed by Stripe Connect. Connected account holders bear full legal and financial liability for any chargebacks or disputes on their account.

1. Acceptance of Terms

By accessing or using KidShowcase, you agree to be bound by these Terms, as well as our Privacy Policy and our privacy guidelines in What You Share Is What They See. If you do not agree to all of these Terms, you may not access or use the platform.

2. Eligibility & Parent/Guardian Authorization

  • Minors & Student Profiles: KidShowcase is designed to highlight youth achievements. Minors under the age of 18 are not permitted to register an account independently. All student profiles must be created, authorized, and managed under the direct supervision of a parent, legal guardian, authorized school representative, or club administrator.
  • Authority: If you are creating a profile, event, or fundraiser on behalf of a school, athletic club, business, or organization, you represent and warrant that you have full legal authority to bind that entity to these Terms.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to immediately notify KidShowcase of any unauthorized use or security breach. KidShowcase is not liable for any losses caused by unauthorized use of your account.

4. Payment Processing, Fees, and Stripe Connect Integration

KidShowcase integrates with Stripe Connect to handle identity verification, secure payment processing, and direct payout transfers.

  • Platform Fees:
    • Direct Student Donations: KidShowcase charges a 0% platform fee. (Standard Stripe processing fees apply).
    • Organization Fundraisers: KidShowcase charges a 5% platform fee on proceeds, in addition to standard Stripe processing fees (~3%).
    • Event Signups & Registrations: KidShowcase charges a 15% platform fee on registrations, in addition to standard Stripe processing fees (~3%).
  • Payout Schedules & Delayed Event Funds:
    • Donation payouts process according to standard Stripe processing schedules once your account is verified.
    • Event Registration Payouts: To protect users against cancellations, non-performance, and fraud, funds collected for camps, clinics, tournaments, and events are held and paid out after the event has occurred (typically within 2–7 days post-completion).
  • Stripe Verification: Account holders receiving funds must complete Stripe’s identity and bank account verification. KidShowcase does not manage, store, or hold bank accounts or payment card details.

5. Chargebacks, Disputes, and Financial Liability

If a donor, parent, or registrant files a chargeback, credit card dispute, or payment reversal with Stripe or their card issuer:

  • Stripe handles the investigation and dispute procedures.
  • The connected account holder (parent, coach, instructor, or organization) who received or was slated to receive the funds is solely responsible for the disputed amount, associated chargeback fees, and negative balances.
  • KidShowcase does not cover, indemnify, or absorb chargebacks, disputes, or fraudulent payment reversals. If a chargeback results in a negative Stripe balance, the connected account holder remains obligated to satisfy the balance directly with Stripe.

6. User Content & Public Exposure

You retain ownership of photos, videos, text, stats, and event listings you upload (“User Content”). However, by posting content to KidShowcase:

  • Public License: You grant KidShowcase a non-exclusive, worldwide, royalty-free license to host, display, reformat, promote, and distribute your content across the platform.
  • Public Visibility: You acknowledge that KidShowcase is a public showcase platform. Information, photos, and media posted on public student profiles or event pages are accessible to scouts, recruiters, and the general public. You are solely responsible for ensuring that uploaded media and personal information are safe for public display.

7. Prohibited Conduct & Community Standards

To ensure a safe environment for youth, you agree NOT to:

  • Post false, deceptive, misleading, or fraudulent profile details, event listings, or fundraising requests.
  • Upload content that is illegal, inappropriate, harmful, defamatory, explicit, or infringing on third-party copyrights/trademarks.
  • Engage in card testing, unauthorized financial harvesting, or automated scraping of platform data.
  • Harass, bully, or contact minors inappropriately.

KidShowcase reserves the right, in its sole discretion, to remove any content, suspend payouts, or terminate accounts that violate these standards without prior notice.

8. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. KIDSHOWCASE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AND ACCURACY OF EVENT OR PROFILE INFORMATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDSHOWCASE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR FUNDS, RESULTING FROM:

  • YOUR USE OR INABILITY TO USE THE PLATFORM;
  • EVENT CANCELLATIONS, DISPUTES BETWEEN ORGANIZERS AND PARTICIPANTS, OR FRAUDULENT EVENTS;
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  • CHARGEBACKS, STRIPE DISPUTES, OR ACTION TAKEN BY STRIPE CONNECT.

10. Indemnification

You agree to defend, indemnify, and hold harmless KidShowcase LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your User Content, or your event/fundraiser operations.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

12. Changes to Terms

We reserve the right to revise or modify these Terms at any time. Updated versions will be posted on this page with an updated "Last Updated" timestamp. Your continued use of KidShowcase following the posting of changes constitutes acceptance of those changes.
